Conditions and stipulations in force

The following conditions and stipulations are applicable to all orders placed through the P-Tronic e-shop (www.ptronic.com). These conditions and stipulations govern sales by Speed-up sprl/P-Tronic as mentioned on the invoice which will be sent for all orders for products sold by Speed-up sprl/P-Tronic, unless a separate formal purchase contract has been concluded with Speed-up sprl/P-Tronic.
By ordering products on www.ptronic.com or by accepting delivery of the products mentioned on the invoice, you recognise and accept these conditions and stipulations. Speed-up sprl/P-Tronic reserves the right to modify these conditions and stipulations at any time and without prior notice. Speed-up sprl/P-Tronic also reserves the right to modify its products with regard to the information communicated through its site www.ptronic.com.

Registration

When you register on the site www.ptronic.com, you are solely responsible for the data recorded. Be sure, therefore, that the obligatory data you supply is precise and exhaustive.
The password which is supplied to you when registering on the site www.ptronic.com is strictly confidential and must not be communicated to third parties. You assume entire responsibility for orders placed, even without your knowledge, using your connection parameters (identification and password). If you suspect third parties of using your connection parameters, you must immediately inform Speed-up sprl/P-Tronic who will supply you with new ones.

Order and price

All the prices shown on the www.ptronic.com e-shop are expressed in GBP and in EUR, inclusive of VAT.
Payment will be debited in EUR.
Carefully examine the description of the product and the technical details before placing an order.
If you have questions about a product, you can always send an e-mail to info@ptronic.com .
Orders placed via www.ptronic.com are only accepted by Speed-up sprl/P-Tronic following receipt on your screen of an order confirmation stipulating that the order has been successfully placed and that payment is approved.

Modes of payment

Speed-up sprl/P-Tronic accepts two modes of payment for products displayed on the site www.ptronic.com :
1. On-line payment by bank card. In this case only, delivery charges in Europe are free of charge and the purchaser benefits from a discount of 15% on displayed prices. Payment is possible with Visa, Eurocard/Mastercard and American Express.
The amount due is debited in EUR.
Speed-up sprl/P-Tronic cannot be held responsible for supplementary charges or fees resulting from transaction indemnities or fluctuations in exchange rates.
Ensure that the credit card number and the expiry date indicated are correct.
Incorrect information can lead to delays in handling your order.
Payment by credit card is subject to the approval of the financial institution issuing the card.
Speed-up sprl/P-Tronic cannot be held responsible in the case of refusal by a financial institution to accept or honour the credit card for any reason whatsoever.
Speed-up sprl/P-Tronic takes all reasonable precautions, within the company's capacity, to render the details of your order and your payment secure.
Except in the case of negligence emanating from within itself, Speed-up sprl/P-Tronic cannot be held responsible for any eventual losses resulting from the fact that a third party may have gained illegal access to the data you have registered during your visit to www.ptronic.com or at the time of your order.

2. payment by bank transfer 

Despatch and transaction

You recognise and accept the payment of all the transaction and despatch costs, as well as of VAT and any other taxes applicable to your order.
These costs are automatically calculated for you and debited to your credit card account at the same time as the total purchase price for the product, at the moment of despatch of your order.
The actual costs may vary and will be charged on your invoice.
Speed-up sprl/P-Tronic works with TNT for the despatch of your order.
This is why it is impossible to deliver to box number addresses.
The despatch and delivery data mentioned are no more than anticipated estimates and Speed-up sprl/P-Tronic cannot be held responsible for losses, damage or charges caused by non-respect of the despatch and delivery data mentioned.

Delivery timing

As manufacturer, Speed-up sprl/P-Tronic commits to reduce to a minimum the delivery time for its products. If this delivery time should nevertheless exceed ten days, Speed-up sprl/P-Tronic will contact the client to inform him of the time when his order will be delivered.
In a case where several P-Tronic additional box-units are purchased in one order, Speed-up sprl/P-Tronic reserves the right to work with part deliveries (staged deliveries) and to record the remaining parts as a back order for future deliveries, unless you immediately inform Speed-up sprl/P-Tronic at the moment of placing the order that you will accept 'a complete delivery only'. You recognise and accept that delivery of orders which can be in 'a complete delivery only' may incur some delay because of your request.

Return within 7 (seven) days

If you are not totally satisfied or if the product reveals a fault within the first seven days after reception, you may return it at your cost for reimbursement or replacement.
Before sending merchandise back to us, you must send us an e-mail, at the latest 7 (seven) days after the invoice date, mentioning the following details: invoice number and date, product number (reference) and reason for return.

Returns procedure

The invoice number is also your TTG number (authorisation to return merchandise). The TTG number must be clearly indicated on the return packaging. Returns without a TTG number and a copy of the original invoice will not be accepted. Merchandise must be returned in its original packaging, with all of the components supplied: box-units, cabling, connectors and accessories. Incomplete products are NOT accepted.
All returns and transaction costs must be paid in advance by the client. Please send your package to the following address:

Force majeure

Speed-up sprl/P-Tronic cannot be held responsible for losses or damage resulting from delays or of non-respect of its obligations within the framework of this contract for reasons of strike, lock-out, revolt, war, fire, natural disaster, accidents, shortages at suppliers or manufacturers of P-Tronic materials, restrictions by the authorities, absence of granting of import or export permits, infringements of the law, prescriptions or orders or for reason of any other circumstance or cause hampering the correct respect of these conditions and stipulations, or any other cause independent of the will of Speed-up sprl/P-Tronic.

Applicable law and jurisdiction

The sale of products is subject to Belgian law in the widest possible sense and the parties recognise the exclusive competence of the commerce tribunal of Huy (Belgium).

Use of electronic messages

The sale of products through the www.ptronic.com e-shop is carried out electronically.
As a consequence of this, you authorise Speed-up sprl/P-Tronic to communicate with you through electronic channels.
Speed-up sprl/P-Tronic can send you e-mails and other communications concerning your order via internet.
You accept in the widest sense of the law that this stipulation replaces all laws which provide for other methods or other time-scales for receipt of messages concerning your order.
Speed-up sprl/P-Tronic reserves the right to send messages and notifications by methods other than normal post, as well as the right to receive written messages provided that this method is prescribed elsewhere in this contract.
In case of litigation, you commit, in the widest legal sense, not to call into question the probative power of electronic orders, communications, messages or notifications within the framework of this contract.

Guarantee

P-Tronic additional box-units are guaranteed for a period of five years starting from the date of purchase mentioned on the purchase invoice. 
This guarantee is assured by our repair centre and concerns all the parts which make up the product as well as the labour. 
In order to assure you the best possible service, we invite you to fill in the registration form attached and to send it to our service centre (Speed-up sprl - 19 Rue Mavoie - 4537 Verlaine - Belgium) within fifteen days from the date of purchase.
In case of breakdown during the guarantee period, you can contact the Service Center to report the problem, and then send the box-unit back to the Service Center. Our Service Center will repair the box-unit and will return it to you within five days following its reception.
The Speed-up sprl/P-Tronic guarantee does not cover damage caused by incompetent use, an accident, fire, unauthorised modifications, non-respect of the instructions supplied by Speed-up sprl/P-Tronic or any repairs carried out by a centre not accredited by P-Tronic. 
P-Tronic reserves the right to repair the box-unit either in its workshops, or to designate another for this purpose. Changes of address must be communicated to Speed-up sprl/P-Tronic in writing, on pain of the guarantee being annulled.

Notification

The P-Tronic additional box-units sold by our company are exclusively destined for motor sport. They are not accredited either by the manufacturers or the insurers. Fitting them risks annulling the manufacturer's guarantee and could be used by insurers as a reason for not covering accidents if the placing of the additional box-unit has not been declared to the insurer. Our company declines all responsibility where refusal of insurance cover or manufacturer's guarantee are involved, or in a case of mechanical or electronic breakdown in a vehicle fitted with a box-unit. It is the responsibility of the purchaser of the additional box-unit to signal the presence of such a piece of equipment in his engine to his insurer.

Integral contract

The conditions and stipulations contained in this contract between Speed-up sprl/P-Tronic and yourself represent an integral and definitive confirmation of the agreements and conventions between the parties concerning the content of this contract, and they replace all the previous conventions, contracts or written or spoken discussions.
The fact that Speed-up sprl does not demand the application of a condition or stipulation of this contract or its rights within the framework of this contract does not signify that Speed-up sprl renounces its rights or its possibility for recourse within the framework of this present contract.
